1. Data controller
Optipathiar Analytics S.A. de C.V. (Tax ID OAN240315BA1), with domicile at Av. Paseo de la Reforma 296, Floor 12, Col. Juárez, Mexico City, is the data controller for personal data collected through optipathiar.com under the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulation.
2. Data we collect
We collect identification data (full name), professional contact data (corporate email, phone), navigation data (IP address, device type, pages visited) and data you voluntarily provide when subscribing to our briefing or requesting demonstrations.
3. Purposes of processing
We use your data to: (i) handle commercial and demo requests; (ii) send high-value communications on Business Intelligence in Mexico; (iii) improve the site and its content; (iv) comply with applicable Mexican legal and tax obligations.
4. Legal basis
Processing is based on your express consent, on the legitimate interest of Optipathiar Analytics S.A. de C.V. and on the fulfillment of legal duties before SAT and other competent Mexican authorities.
5. Data transfers
We do not transfer your data to third parties for commercial purposes. We may share information with technology providers (hosting, analytics) under confidentiality clauses and with authorities when the law requires so.
6. ARCO rights
You may exercise at any time your rights of Access, Rectification, Cancellation and Opposition (ARCO), as well as revoke your consent, by writing to privacy@optipathiar.com. We have a maximum period of 20 business days to respond.
7. Security measures
We implement administrative, technical and physical measures aligned with ISO 27001, including TLS 1.3 encryption, role-based access control and audit logs.
8. Retention
Data is retained for the time strictly necessary for the described purposes and to comply with tax obligations (5 years, article 30 of the Mexican Federal Tax Code).
9. Changes to this notice
Any material modification to this policy will be notified through prominent publication on optipathiar.com at least 30 days before it enters into force.
